Media Release

By purchasing a FastAPI Conf ticket, you have read this release (“Release”), are fully familiar with the contents thereof, agree to the terms herein and hereby grant FastAPI Labs, Inc. (“FastAPI Labs”), and its assigns, licensees, successors in interest, legal representatives, and heirs the right to use and exploit, in whole or in part, the following: (i) all photographs, film, video recordings, audio and sound recordings, and livestream or other recordings that capture, depict, embody, or include your person, voice, image, likeness, or participation, or any spaces, whether captured by or on behalf of FastAPI Labs at or in connection with the conference or displayed or provided (or to be displayed or provided) by you to FastAPI Labs, including any interactions with FastAPI Labs representatives at the conference (“Media”); (ii) any oral or written statements, quotes, references, or information that you give to FastAPI Labs (including, without limitation, any in-person interviews, online video conference interviews, testimonials, telephone or audio interviews, and/or email question and answer exchanges) (“Testimonials”), including the right to quote or paraphrase all or any portion of the Testimonials, and to generally use and publish the Testimonials, including your experiences, recollections, incidents, remarks, dialogue, actions, and information, as well as any photograph(s) that you provide to FastAPI Labs in connection with the Testimonials (all the foregoing, the “Testimonial Materials”); and/or (iii) your name, portrait, picture, voice, biographical information, and likeness (“Likeness”), in each case in all forms and in all media and in all manners now known or hereafter created or devised, throughout the world and in perpetuity, including any composite, edited, altered, or distorted representations of the same, for advertising, trade, promotional, editorial, archival, educational, and any other lawful purposes in connection with the use, promotion and/or sale of FastAPI Labs’ business, products, and/or services.

You hereby waive any right to inspect or approve the Media, Likeness, Testimonials or printed or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to you or unknown. You forever release and discharge and covenant not to sue FastAPI Labs and/or any of its licensees, designees, and assigns from any and all claims whatsoever (including, without limitation, any claims related to defamation, false light, or the invasion of any right of privacy or publicity) arising out of or in connection with the use of the Media, Likeness or Testimonials. It is the discretion of FastAPI Labs to decide whether and how to use the Media, Likeness or Testimonials.

If you do not wish to be photographed, filmed, recorded, or interviewed, you may opt out at any time by either (i) emailing FastAPI Labs at hello@fastapiconf.com before or during the conference, or (ii) wearing a “Do Not Photograph” pin, available at the conference registration desk, so that FastAPI Labs’ representatives can identify your preference. Upon receiving notice of your election, FastAPI Labs will make reasonable efforts to refrain from capturing your Media, Likeness, and Testimonials and to exclude you from targeted photography, filming, recording, and interviews. Because the conference is held in shared, public event spaces, however, FastAPI Labs cannot guarantee that you will be excluded from all incidental crowd photographs, livestreams, or recordings. To the extent your agreement to this Release constitutes consent under applicable data protection law, you have the right to withdraw that consent at any time by emailing FastAPI Labs at hello@fastapiconf.com. The withdrawal of consent will not affect the lawfulness of any processing carried out before your withdrawal, and FastAPI Labs may continue to use any Media, Likeness, Testimonials, and Testimonial Materials that were already published, distributed, or incorporated into third-party or archived materials before the withdrawal took effect.

Any personal data contained in the Media, Likeness, Testimonials, and Testimonial Materials will be processed in accordance with FastAPI Labs’ Privacy Policy, available at https://fastapicloud.com/legal/privacy-policy.

Nothing herein shall be construed to obligate FastAPI Labs to produce, distribute or use any of the rights granted herein. You acknowledge and agree that you have received adequate consideration for the rights and releases granted in this Release and waive any right to royalties or other compensation arising from or related to the use of the Media, Likeness, Testimonials and Testimonial Materials. This Release shall be construed according to the laws of the State of Delaware applicable to agreements that are executed and fully performed within said State; provided, however, that nothing in this Release deprives you of, or limits, any mandatory or non-waivable rights you have under the laws of your country of residence or under applicable data protection law, and the waivers and releases above apply only to the maximum extent permitted by such laws. You hereby represent and warrant to FastAPI Labs that you are eighteen (18) years of age or older. This Release contains the entire understanding of the parties relating to the subject matter contained herein, and this Release cannot be changed except by written agreement executed by the party to be bound. FastAPI Labs may freely assign, transfer, license, or sublicense this Release and any of its rights or obligations hereunder, in whole or in part, to any person or entity without your consent. This Release shall be binding upon you and your heirs, legal representatives, and assigns.
